AD LISTING CHARTER
RULES FOR LISTING, DELISTING, AND RANKING OF ADS
To ensure Users can browse the Site and use the Services with confidence, the following rules outline how Passetonbillet:
• lists or delists an Ad on its Site;
• ranks Ads on its Site.
1. DEFINITIONS
For the purposes of this document, the following terms and expressions, whether used in the singular or plural, will have the meanings defined below:
• Ad: Refers to any listing or offer to sell a Ticket created and posted by a Seller on the Site.
• User Account: Refers to the personal space of the User on the Site.
• Content: Refers to any content posted by a User on the Site, including texts, photographs, videos, drawings, illustrations, audio elements, trademarks, logos, titles, and descriptions.
• Service: Refers to any service (e.g., event access, transportation) provided through the Ticket.
• Services: Refers to the services offered by the Company on the Site, enabling the purchase and resale of Tickets between private Users.
• Site: Refers to the online platform operated by the Company and accessible at https://www.passetonbillet.fr/.
• Company or Passetonbillet: Refers to NITO, a simplified joint-stock company with a share capital of €27,500, headquartered at 15 Boulevard Victor Hugo, 92200 Neuilly-sur-Seine, registered in the Nanterre Trade and Companies Register under number 513 007 880.
• Rightsholder: Refers to any person responsible, in any capacity, for organizing or providing the Service, holding exploitation or commercialization rights over the Service, such as the producer, organizer, rights owner, or service provider.
• User: Refers broadly to any user of the Site, including anyone browsing the Site and/or using the Services provided by the Company.
• Seller: Refers to any User who lists a Ticket for sale on the Site.
2. RULES FOR LISTING AND DELISTING ADS
This section outlines the rules that Sellers must follow to have their Ad listed and published on the Site. Any Ad that violates current legal provisions or the Site’s publishing rules described below will be rejected by Passetonbillet and will not be listed. Passetonbillet will not be held responsible for such rejections.
2.1. Listing Conditions
2.1.1. Access Conditions for Ad Publication
Ad publication is restricted to non-professional Users residing in the countries specified on the Site and who have created a User Account.
The User must provide a valid identity document (national ID card, passport, or driver’s license) and their IBAN.
In case of doubt regarding the authenticity of the provided information, the Company reserves the right to request additional verification and/or refuse the Ad publication.
2.1.2. Ad Description
The Seller must provide detailed information about the electronic Ticket, including the event name and its selling price.
Sellers are required to specify any relevant details about the Ticket, such as ticket type, precise entry times, child tickets, disabled access, or any membership card requirements.
For electronic Tickets with assigned seat numbers, Sellers are encouraged to include seat details in the Ad description.
The Seller warrants the accuracy and truthfulness of the information provided in their Ad.
However, the Company reserves the right to modify information in the Ad if it is incorrect or does not match the original Ticket.
2.1.3. Conditions Regarding the Ad and Ticket for Sale
a) Legality of Ticket Resale
The Seller may only list and sell a Ticket if:
• They are the Rightsholder of the Service linked to the Ticket.
• They are explicitly authorized by the Rightsholder to sell Tickets on their behalf.
• The Company has been authorized by the Rightsholder to operate a Ticket exchange platform.
• The Seller does not habitually sell Tickets on the Site.
• The Ticket is not stolen.
b) Ticket Resale Price
The Seller determines the resale price freely, but it must not exceed the Ticket’s original purchase price unless local laws allow such markup.
The Seller must set a fair price reflecting the Ticket’s market value and comply with applicable laws.
The Company reserves the right to remove Ads with resale prices that violate applicable laws or these conditions.
c) Authenticity of the Ticket
The Seller must upload the original digital Ticket. Scanned Tickets, photos, or modified files are strictly prohibited.
2.2. Delisting
Any Ad found to violate the listing conditions, particularly following a report by a third party, may be delisted by Passetonbillet without refund or compensation to the User.
2.3. Reporting an Ad
If a User or third party believes that any Content on the Site is illegal, they can report it to the Company.
Under Article 6-I-5 of Law No. 2004-575 of June 21, 2004, Users may be asked to provide the following:
• Full name, date, and place of birth, postal address;
• Date of the report;
• Identification details of the reported Content;
• URL(s) of the Content;
• Reasons for requesting removal, including legal references and factual justification;
• Copy of correspondence sent to the Content’s author requesting its removal, or proof that the author could not be contacted.
Misuse of this reporting process may result in legal consequences, as outlined in Article 6.I.4 of the same law, which imposes penalties for false reports.
3. RULES FOR AD RANKING
3.1. Homepage Ranking
On the Site’s homepage, Ads and Ad categories are displayed randomly.
3.2. Search Results Ranking
3.2.1. Default Ranking
When searching for a Ticket, Ads are ranked by the chronological order of the event’s date (“Newest”).
3.2.2. Sorting Options
Users can sort Ads by:
• Ascending ticket price;
• Ascending event date;
• Ascending Ad publication date.
3.2.3. Filtering Options
Users can filter Ads by:
• Event period: today, this week, this weekend;
• City or venue of the event.
3.2.4. Paid Promotion Options
Ads with paid promotion options are prioritized and displayed first in search results.
