AD LISTING CHARTER
LISTING, DELISTING AND RANKING RULES FOR LISTINGS
In order to allow Users to browse the Website and use the Services with confidence, these rules describe how Passetonbillet:
- lists or delists a Listing on its Website;
- ranks Listings on its Website.
1. DEFINITIONS
In this document, the following terms, whether used in the singular or plural, shall have the meanings set out below:
- Listing: any listing or offer to sell a Ticket created and posted by a Seller on the Website.
- User Account: the User’s personal account space on the Website.
- Content: any content posted by a User on the Website, including texts, photographs, videos, drawings, illustrations, sound elements, trademarks, logos, titles and descriptions.
- Service: any service (event access, transport, etc.) to which a Ticket grants access.
- Services: the services provided by the Company on the Website enabling the purchase and resale of Tickets between individual Users.
- Website: the online platform published by the Company and accessible at https://www.passetonbillet.fr/
- Company or Passetonbillet: NITO, a simplified joint-stock company (SAS) with a share capital of €27,500, having its registered office at 15 Boulevard Victor Hugo, 92200 Neuilly-sur-Seine, France, registered with the Nanterre Trade and Companies Register under number 513 007 880.
- Rights Holder: any person responsible, in any capacity, for organizing or providing the Service, holding the rights to exploit or market such Service, including in particular the producer, organizer, rights owner or service provider.
- User: any user of the Website, meaning any person browsing the Website and/or using the Services provided by the Company.
- Seller: any User offering a Ticket for sale on the Website.
2. LISTING AND DELISTING RULES FOR LISTINGS
This section sets out all the rules that Seller Users must comply with for their Listing to be listed and displayed on the Website. Any Listing that does not comply with applicable laws or with the Website’s listing rules described below will be rejected by Passetonbillet and therefore not listed, without this giving rise to any liability on the part of Passetonbillet.
2.1. Listing Conditions
2.1.1. Conditions for Access to the Listing Publication Service
Publishing a Listing is reserved for non-professional Users residing in the countries expressly indicated on the Website and who have created a User Account on the Website.
The User must provide a valid identity document: national identity card, passport or driver’s license.
The User must also provide their IBAN.
In case of doubt regarding the accuracy of the information provided, the Company reserves the right to request additional information for verification purposes and/or to refuse publication of the Listing.
2.1.2. Listing Description
The Seller must provide complete information relating to the electronic Ticket, including at a minimum the name of the event and the sale price.
The Seller undertakes to provide all relevant information relating to the electronic Ticket, including ticket type, precise entry times, child tickets, accessibility access, and any requirement for a membership card.
For electronic Tickets assigned to a seat number, it is recommended to specify the seat numbers in the Listing description.
The Seller declares that all information provided in the Listing is accurate and truthful.
The Company nevertheless reserves the right to modify information displayed in the Listing if it is incorrect or does not reflect the information shown on the original electronic Ticket.
2.1.3. Conditions Relating to the Listing and the Ticket Offered for Sale
a) Lawfulness of Ticket Resale
In accordance with applicable law, the Seller is authorized to publish a Listing and offer a Ticket for sale only if:
- The Seller is a Rights Holder of the Service covered by the Ticket offered for sale.
- The Seller is expressly authorized by the Rights Holder of the Service to sell or offer Tickets for sale on behalf of the Rights Holder.
- The Company is authorized by the Rights Holder to operate a ticket exchange allowing its Users to freely buy and sell Tickets directly with one another.
- The Seller does not habitually offer Tickets for sale on the Company’s Website.
- The Ticket is not the proceeds of theft.
b) Ticket Resale Price
The resale price of the Ticket is freely set by the Seller.
However, it may in no case exceed the original purchase price of the Ticket, except where local laws expressly allow such a markup.
The Seller must set a sale price that fairly reflects the value of the Ticket in light of market conditions and in compliance with applicable local legislation.
In this respect, the Company reserves the right to remove any Listing whose resale price does not comply with applicable regulations or these rules.
c) Original Nature of the Ticket
The Seller must upload an original digital Ticket file.
Scanned Tickets, photographs, or modified files are strictly prohibited.
2.2. Delisting
Any Listing found to be in breach of the listing conditions set out above, in particular following a report by a third party, may be delisted by Passetonbillet, without refund or entitlement to any compensation for the User.
2.3. Reporting a Listing
If a User or a third party considers that all or part of Content published on the Website may be manifestly unlawful, they may report it to the Company.
In accordance with Article 6-I-5 of French Law No. 2004-575 of 21 June 2004, the reporting party may be asked by the Company to provide, in writing, the following information:
- last name(s), first name(s), date and place of birth, postal address;
- date of the report;
- identification details of the disputed Content;
- URL address(es) of the disputed Content;
- reasons why the Content should be removed, including references to legal provisions and factual justifications;
- a copy of correspondence sent to the User who posted the disputed Content requesting its removal or modification, or justification that the author could not be contacted.
In this respect, the author of the report undertakes not to abuse this procedure. Failing this, they acknowledge that they may be subject to criminal prosecution pursuant to Article 6.I.4 of French Law No. 2004-575 of 21 June 2004, which provides that presenting content or activity as unlawful in order to obtain its removal while knowing that such information is inaccurate is punishable by one year of imprisonment and a fine of €15,000.
3. LISTING RANKING RULES
3.1. Ranking of Listings on the Website Homepage
When a User browses the Website homepage, Listings and Listing categories are displayed randomly.
3.2. Ranking of Listings on Search Results Pages
3.2.1. Default Ranking
When searching for a Ticket on the Website, Listings are displayed by default in chronological order (“Most recent”) based on the date of the Service covered by the Ticket.
3.2.2. Sorting Options
On each results page, Users may modify the ranking by sorting Listings according to the following criteria:
- Ticket price (ascending);
- Chronological order of the Service date (ascending);
- Chronological order of Listing publication date (ascending).
3.2.3. Filtering Options
On each results page, Users may also filter Listings according to the following criteria:
- Service period: all periods, today, this week, this weekend;
- City or venue where the Service covered by the Ticket takes place.
3.2.4. Impact of Paid Promotion Options
Subscription to paid promotion options influences the ranking of Listings, with promoted Listings always displayed first in search results.
